In today's Britain, protest is no longer a fundamental right. Instead, it has become a privilege that authorities allow or deny as they see fit. This constitutes the implication of new regulations that the current government is advancing, which would determine the timing and location demonstrations can occur, with possible prison sentences for those who defy these restrictions.

Erosion of Democratic Rights

Previous governments had already weakened this essential right: the former Conservative government had given law enforcement extensive additional powers, which global rights bodies had censured as "serious and undue limitations" on civil liberties. Taken together, these progressive assaults on freedom have effectively eliminated the hard-won right to freedom of protest.

Using Atrocity to Justify Suppression

The latest restrictive measures are being justified by referring to last week's terrible anti-Jewish attack on a Manchester Islamic center. There should be universal agreement that the security of Jewish communities in Britain must be protected. However, employing this horrific incident as a pretext to stifle opposition is not only unrelated to that responsibility but perverts it.

"When you can't draw the line at genocide, you probably can't establish limits at democratic principles," commented a prominent American author, a statement that applies equally for the present administration.

Historical Context of Demonstration

Consider Britain's long tradition of protest and activism against racial discrimination and authoritarianism, from the 1936 Battle of Cable Street to postwar Jewish anti-fascist movements and the 1970s demonstrations against the far-right organization. Many of these early protesters were branded as extremists in their time, even while they were fighting for the freedoms of marginalized groups.

Current Reality

In the current complex situation, here's what's actually happening: Israel – a foreign state – is perpetrating acts that international bodies have described as systematic destruction. Its warfare have led the global justice body to release legal indictments against Israel's prime minister and his former defense minister.

Western popular sentiment has changed significantly against Israel's violent actions. In Britain, a substantial majority of the public believe Israel has likely committed war crimes. Most people would support a total prohibition on arms sales to the state, and approve the arrest of Netanyahu.

Silencing Dissent

Having largely failed the argument, Israel's supporters are now exploiting a despicable antisemitic crime to attempt to suppress a popular campaign against a moral catastrophe. The British government seems included in this effort. Government officials have not enacted extensive restrictions on Israel and have permitted arms exports to proceed.

People who are protesting against the erasure of Gaza have been characterized as dangerous radicals. Yet there's a important factor why there hasn't been a broader crackdown on these demonstrators until now: very limited protesters have made truly offensive statements about Jewish people, giving police authorities minimal reason to intervene.

Problematic Association

Equating Jewish heritage with the actions of the Israeli state is not only cynical but also dangerous. The official definition of anti-Jewish prejudice, accepted by the British government and numerous institutions, has been rightly questioned for potentially restricting valid commentary of Israel. However, there should be no disagreement about one of its central illustrations: that "holding Jewish people generally accountable for decisions of the state of Israel" constitutes prejudice against Jews.

Escalating Restrictions

This is why we've arrived at a situation where law enforcement can propose that demonstrations opposing Israel's actions should be canceled because they might "accidentally or intentionally" endorse antisemitism. Similarly, government officials have stated that recognition of Palestinian statehood has made organizations "implicated" in alleged abuse experienced by British Jews.

Inconsistent Treatment

On the same day as the religious center assault, the Israeli military killed numerous of Palestinians in Gaza – increasing the horrific toll from two years of ongoing violence that have taken many thousands of lives. British politicians and media outlets have barely concealed the minimal importance they assign to Palestinian existence. This represents one of the boldest expressions of racism in contemporary society.

Breaking Boundaries

Our government has already crossed a concerning boundary by proscribing Palestine Action, a peaceful, human rights-focused direct action organization. Multiple thousands of British protesters have been arrested, primarily for carrying signs opposing mass killing and endorsing the proscribed group. Many of those arrested are elderly citizens; among them a retired priest and the daughter of a World War II genocide survivor.

Global Comparisons

It's not difficult to see where this trajectory leads. In the United States, political leaders helped demonize pro-Palestinian protests: a ex-political leader implied that some were "connected to" foreign governments, while the sitting leader described such protests as anti-Jewish. In taking these actions, they helped legitimize the authoritarian crackdown on such protests – and on freedom of expression in general.

Future Concerns

If a conservative administration comes to power, it would be granted extensive authority to suppress opposition. What might a new administration do with this restrictive framework? Our ancestors struggled, endured hardship and died to establish our liberties. We may ultimately regret how easily we allowed them to be eroded.
